Protecting a consumer's privacy

Protecting a consumer's Personal Identifiable Information (PII) can help reduce the risk of information being disclosed inappropriately and reduce the risk of identity theft.

This obligation includes compliance with the provisions of the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule and its specific rules regarding uses and disclosures of beneficiary information.

Protecting the consumer's Personal Health Information (PHI) and PII

  • Use encruption on your laptops, iPads and/or other portable electronic devices
  • Do not leave completed paper enrollment applications in your car
  • Do not leave your laptop/portable electronic device unsecured
  • Do not ask medical questions during a sales event; be careful of "eavesdropping"
  • Do not use consumer or member information to generate non-compliant leads

Important Note

Your laptop/portable electronic device may contain PHI and PII including but not limited to:

  • A benficiary's Health Insurance Claim Number (HICN)
  • Health information
  • Social Security number
  • Date of birth
  • Address

If your laptop/portable electronic device is lost or stolen and it is not encrypted, the information contained on it may be accessed by a third party. You must notify your business hierarchy and the police immediately. This is considered a privacy breach under federal and some state laws.
